Windsor Law Firm Launches Class Action Lawsuit Against AshleyMadison.com

Windsor law firm Sutts, Strosberg LLP along with Charney Lawyers have filed a national class proceeding on behalf of all Canadians who subscribed to Ashley Madison and whose personal information was disclosed to the public. The action is brought against Avid Dating Life Inc. and Avid Life Media Inc., the corporations that run AshleyMadison.com.

The plaintiff in the lawsuit is Eliot Shore, a disabled widower who resides in Ottawa. Mr. Shore was single again after 30 years of marriage after he lost his wife to breast cancer. He joined the website for a short time in search of companionship but never met anybody in person from the site.

The allegations in the class action include that the privacy of many thousands of Canadians was breached in July 2015 when hackers infiltrated AshleyMadison.com and downloaded private information. The data breach includes users’ personal names, emails, home addresses and message history. In August 2015, this information was posted online for public viewing.

Numerous former users of AshleyMadison.com have approached the law firms to inquire about their privacy rights under Canadian law. They are outraged that AshleyMadison.com failed to protect its users’ information. In many cases, the users paid an additional fee for the website to remove all of their user data, only to discover that the information was left intact and exposed.

The class action is not being brought against the Impact Team hackers who attacked AshleyMadison.com.
