The Ontario Special Investigations Unit has concluded an investigation into an incident in October when a man exposed himself to a female officer outside Windsor Police HQ and ended up with a fractured arm after being arrested.
The SIU says that around 10pm on Friday October 12th, a man was causing a disturbance in front of Windsor Police HQ when a female officer exited the building to see what was going on. The man shouted obscenities at the officer. Two other officers came out of the building to assist. The man reportedly dropped his pants and exposed himself to the female officer. The officers grabbed the man and attempted to arrest him for causing a disturbance and performing an indecent act.
An officer took hold of the suspect’s right hand but the man continued to struggle and did not comply. Eventually the man’s hand was brought behind his back for handcuffing. The man was taken to Hotel Dieu after complaining of a sore elbow. Doctors determined that the man had a spiral fracture to his right arm caused during the arrest.
Director Ian Scott of the SIU says, “The subject officer had the lawful authority to assist in the arrest of the complainant because the officer found him committing the alleged offences of causing a disturbance and performing an indecent act. The officer then had the lawful authority to use reasonable force to effect the arrest. Given the man’s noncompliance during the arrest, I am of the view that the force used was not excessive notwithstanding the serious injury he sustained.”
No charges will be laid against the arresting officer.
